Australand Development 77-89 Military Road

Places Victoria, in partnership with Australand Property Group, has developed plans for the vacant site at 77-89 Military Road, Avondale Heights.

The application was formally advertised in early 2015 and Council made a decision to approve the application at the Ordinary Council Meeting on Tuesday, 26 May 2015. View the Council report.

Key features of the approved application include:

  • provision for 135 dwellings
  • a maximum building height of two storeys
  • a range of dwelling types and sizes from one bedroom to five bedrooms
  • provision for 3,000m2 of centrally located public open space
  • a road network separated into two parts, with a loop road providing access through either end of the development site

In addition to the above, the approved application allows for the subdivision of the development site along with the removal of some native vegetation.

October 2015 update – VCAT appeal

We have been informed that, in July 2015, two appeals to the approved planning permit were lodged with the Victorian Civil and Administrative Tribunal (VCAT).

The first appeal, lodged by local residents, contests our decision to approve the development. The second appeal, by the permit application, challenges a number of conditions on the permit including conditions relating to all developer contributions, the wording of the Construction Management and Landscape Plans and the WSUD requirements together with a number of other standard conditions.

VCAT has combined the hearings for both appeals. The hearing dates are Wednesday, 14 October to Friday, 16 October 2015.

Update on VCAT appeal – 21 October 2015

The VCAT hearing for both appeals took place on Wednesday, 14 October only. The applications for review are now being considered by VCAT who will release an order in due course.

VCAT order – 4 November

Following the hearing on 14 October, VCAT has issued an order affirming Council’s position to support the proposal, subject to some modifications to the conditions outlined in Council’s Notice of Decision.

As directed by VACT, the planning permit will be issued in the coming days.

Our role

We are not the decision maker in this instance. VCAT is the decision making body and we are a participant in the process. We will however keep the community updated as we find out more.
